BREAKING: DSS Loses Against Emefiele In Court (DETAILS)

Justice Hamza Muazu of the Federal Capital Territory High Court in Abuja has rejected a request filed by the Department of State Services (DSS) for a 14-day extended detention order for the suspended Central Bank Governor, Mr. Godwin Emefiele. The DSS had based its application on alleged new evidence that had been discovered.

The application was quietly submitted by the DSS’s legal team on Wednesday and was brought before the vacation judge on the following day.

Justice Muazu dismissed the application, citing it as an abuse of the court process and pointing out the lack of jurisdiction.

During the court proceedings, the judge questioned the court’s authority to grant such a detention order, as the exclusive right to do so lies with the Magistrate Court under Sections 293 and 296 of the Administration of Criminal Justice Act. In response, the DSS’s counsel, Mr. Victor Ejelonu, chose to withdraw the matter.

The DSS’s application was made after Mr. Emefiele’s re-arrest on the premises of the Federal High Court in Lagos, where he was awaiting the fulfilment of his bail conditions, as previously granted by Justice Nicholas Oweibo.
