to a lawsuit filed by legal practitioner Chinwike Ezebube on February 13, 2024.

The court clarified that it is the responsibility of the relevant issuing authorities, rather than vehicle owners or drivers, to ensure that number plates remain clear and visible. As a result, drivers cannot be held liable for faded plates.

Ezebube’s lawsuit questioned whether the FRSC, as the sole designer and producer of vehicle number plates in Nigeria, is responsible for their quality and durability. He also sought an order for the FRSC to replace faded plates at no cost, due to poor manufacturing quality.

In its response, the FRSC’s legal team requested the dismissal of the suit with punitive costs. However, Justice Aluko ruled that while the FRSC cannot criminalize the use of faded plates or impose fines, drivers should approach the FRSC for replacements, provided they pay the appropriate fees.

The court issued an order restraining the FRSC from declaring it an offense to drive with a faded number plate and from imposing fines or penalties on drivers for doing so. It also directed that Ezebube’s faded number plate be replaced by the FRSC upon payment of the necessary fees.
