US Court Dismisses Olukoya’s Suit Against UK-Based Blogger

The United States District Court, Northern District of California, has dismissed the N500m damages registered in the United Kingdom on behalf of the General Overseer of Mountain of Fire and Miracles Ministries (Worldwide), Dr Daniel Olukoya, and the church against a UK-based blogger, Maureen Badejo.

The court also declined personal jurisdiction over the defendants and denied the plaintiffs’ motion for default judgment.

Badejo was said to have published libellous publications against Olukoya and MFM for which Justice Abiodun Akinyemi of an Ogun State High Court in Abeokuta, awarded N500,000m damages.

But the US Court District Judge 1, Haywood Gilliam Jr., in his judgment obtained on Monday, denied the motion for default judgment and dismissed the case “for lack of personal jurisdiction.”

The document was titled, ‘Defendants. Case No.  20-cv-08001-HSG Order denying the motion for default judgment and dismissing case’

“The case is dismissed.  The Clerk is directed to terminate the case. It is so ordered,” Gilliam, said.

He added, “For the following reasons, the court denies the motion for default judgment and dismisses the case for lack of personal jurisdiction.

“Plaintiffs allege only that Ms Badejo is a Nigerian-born blogger who resides in the United Kingdom; that she operates an online news site, Defendant Gio TV, with an emphasis on Nigeria; and that this online news site is accessible on Facebook, YouTube, and Instagram.

“The allegations are insufficient to establish general personal jurisdiction over defendants. Plaintiffs argue that the court has specific personal jurisdiction over defendants because the defendants’ minimum contacts with California satisfy the Ninth Circuit’s three-prong test.

“This is a state law defamation case against defendant Maureen Badejo, a foreign national who appears to be a Nigerian citizen and resides in the United Kingdom. Plaintiffs filed a motion for entry of default on February 3, 2021, and entry of default was noticed by the Clerk on February 4, 2021.  Dkt. Nos. 16, 17.

“At the initial case management conference on February 16, 2021, the court expressed to plaintiffs’ counsel concern that the court lacked subject matter and personal jurisdiction over this matter.

“Counsel responded that he would consult with his clients to either file a notice of dismissal or a motion for default judgment that set out the basis for the court to exercise jurisdiction.”

The judge said in determining whether the exercise of personal jurisdiction over a non-resident defendant was proper, a district court must apply the law of the state in which it was sitting when there was no applicable federal statute governing personal jurisdiction.

“District courts in California may exercise personal jurisdiction over a non-resident defendant to the extent permitted by the due process clause of the constitution,” he added.

Management of the Synagogue Church Of All Nation, SCOAN, has said that the unfortunate demise of the church’s founder, Temitope Balogun Joshua popularly known as TB Joshua will not stop the work of God from moving on.

Recall that the renowned prophet died last week Saturday shortly after hosting a programme in the church where he performed his usual miracle in the name of Jesus Christ.

The family had said the interment of the late prophet was scheduled to hold on July 9 at the church’s premises in Lagos Nigeria.

According to a member of the family who preferred to remain anonymous, the decision followed a meeting by the deceased immediate family where they both agreed on burying the remains of the cleric at the church.

Confirming the burial arrangement, SCOAN noted that the programme would commence on July 5 through to July 11 saying it would be broadcast live on Emmanuel TV.

SCOAN made this known on Monday evening in a statement issued and posted on the deceased verified Facebook page.

The statement reads, “Good Morning and Win Today! Dear SCOAN and Emmanuel TV family all over the world, we appreciate your continued prayers, love and support.

“We know you are aware that our father in the Lord, Prophet TB Joshua, has been taken home to be with the Lord. We want to assure you that nothing will stop the work of God at The SCOAN from moving on. Prophet TB Joshua may be absent in the body but he is present in the spirit (Colossians 2:5). Indeed, God is even more powerful at distance!

“We are currently preparing for the week-long service from Monday 5th to Sunday 11th July 2021 in honour of Prophet TB Joshua’s life and legacy. He will be laid to rest at The Synagogue, Church Of All Nations (SCOAN) in Lagos, Nigeria.

Family gives date for T.B Joshua’s burial
“All services will be broadcast live on Emmanuel TV. The services which will be open to the public will be communicated to you at the appropriate time.

“As our father in the Lord, Prophet TB Joshua says, “When we close our eyes to all things in this world, we shall open them in a world of glory.”

A renowned Nigerian Prophet and founder of Christ MercyLand Deliverance Ministries, (CMDM), Warri, Delta State, Prophet Jeremiah Omoto Fufeyin has expressed shock over the demise of the popular Nigerian Prophet, Temitope Balogun Joshua, popularly known as TB Joshua.

T.B Joshua was confirmed dead on Sunday morning after he had hosted a programme in his church, the Synagogue Church of All Nations (SCOAN) in Lagos State Nigeria.

Reacting to the death which plunged the entire nation into mourning since Sunday, Prophet Jeremiah described the deceased as a Kingdom General who needed to be celebrated, dead or alive.

According to him, TB Joshua lived a good life by affecting many lives positively while he was alive, stressing that the deceased man of God must have gained entrance into heaven where he would rest with the Lord.

While leading his church congregation to mourn the late prophet, the billionaire pastor and his members observed one-minute silence in honour of the deceased.

He said, “The church of God has lost a soldier but heaven gained a soul. We pray for the family and the entire members of SCOAN and Emmanuel TV, that they will be comforted in Jesus Name”.

Rev. Chris Okotie, the Shepherd Superintendent of the Household of God Church, on Tuesday morning shared a cryptic post on his Facebook page in which he referenced a certain ”wizard of Endor” who assumed the title of ”Emmanuel”.

The clergyman in his post said the wizard who assumed the title of Emmanuel had been consumed by divine indignation.

His post comes days after a clergyman, T.B Joshua, who was known for using the name ”Emmanuel” in his church, died.

Okotie further noted that the day of God’s vengeance has fully come to Nigeria though it wasn’t clear who he was directly referencing in his post.

”Hebrews 1:13 says Sit at my right hand until I make your enemies your footstool.

”The wizard at Endor who assumed the title Emmanuel has been consumed by divine indignation. And now his disciples bewail his ignominious exit.

”No marvel, one-third of God’s angels followed the disgraced anointed cherub Lucifer!!

”Jesus our mighty gladiator has broken the head of the dragon with his mighty blows.

”He has descended from the mountain of spices with the fiery sword of his indignation. Glorious in his apparel and travelling in the greatness of his strength, he goes conquering and to conquer the adversaries of his church.

”Let those who swear by the Lord and by Malcham and the descendants of Haman, now tremble in fear.

”The day of the vengeance of our God has fully come to Nigeria. And they shall not escape,” he wrote.
