In its ruling, the Supreme Court maintained that Kanu must undergo trial at the Federal High Court. The Court also stated that despite the Nigerian Government’s recklessness in unlawfully bringing Kanu from Kenya, such an act did not strip any court of its authority to proceed with the trial.

Justice Lawal emphasized the absence of any Nigerian law cited in the lawsuit seeking Kanu’s release due to the alleged unlawful abduction from Kenya.
The Court suggested that the appropriate course of action for Kanu would be to file a civil case against the act instead of nullifying the courts’ powers to continue his trial on criminal charges.
