In a suit filed by his lawyer, Bayo Onifade, Damilare contends that he has been detained in NDLEA custody since September 25, 2024, without formal charges.

The applicant is seeking:

  • A declaration that his arrest and continued detention without trial are unconstitutional and void.
  • Immediate release from NDLEA custody.
  • ₦50 million in damages for unlawful arrest and detention.

Damilare claims the NDLEA is attempting to implicate him by associating him with cannabis discovered at a suspected drug hideout in September 2023, despite no incriminating evidence found during a raid of his residence.

His affidavit, deposed by Babatunde Adelakun, describes how NDLEA operatives seized personal and company property from Damilare’s home but later placed his framed photographs beside bags of cannabis in a publication claiming he was “at large.”

According to the affidavit, despite written protests by his legal team and attempts to clarify his innocence, Damilare was arrested a year later while conducting banking transactions.
