Falana’s statement comes in response to reports of EFCC operatives attempting to arrest Bello over an ongoing investigation into financial fraud. Despite the attempt, Bello was reportedly smuggled out of his residence by his successor, Governor Usman Ododo.
Referencing Section 35(1)(c) of the Nigerian Constitution, Falana emphasized that law enforcement agencies have the power to arrest a suspect when there is reasonable suspicion of criminal activity, regardless of their former status as a governor.
He further clarified that no court can grant a former governor life immunity from arrest and prosecution, as evident in legal precedents. Falana cited a Supreme Court ruling that highlighted the inability of a High Court order to prevent the arrest of a criminal suspect by a court of coordinate jurisdiction.
The statement underscores the principle that no individual, regardless of past political positions, is exempt from investigation and prosecution if there are reasonable grounds to suspect criminal behavior.
