Garland in November 2022, Smith stepped down on January 10, just days before Trump’s second inauguration. His resignation was disclosed in a court filing submitted to US District Judge Aileen Cannon in Florida.

“The Special Counsel completed his work and submitted his final confidential report on January 7, 2025, and separated from the Department on January 10,” the filing stated.

Trump’s Legal Battles and DOJ Tensions

Smith’s resignation comes amidst fierce opposition from Trump, who has consistently criticized him and vowed to remove him upon returning to office. Trump has even suggested Smith should be “thrown out of the country.”

Despite concluding his investigations, Smith’s report remains at the center of a heated legal battle. Trump’s team, along with his former co-defendants, is pushing to block the Department of Justice from releasing portions of the report to Congress.

The DOJ, however, filed an emergency motion urging a federal appeals court to overturn Judge Cannon’s temporary order, which currently prevents the report’s release. DOJ officials argue that delaying the report’s disclosure undermines transparency and accountability.

A Controversial Tenure

Judge Cannon had previously dismissed the Mar-a-Lago classified documents case against Trump, citing constitutional concerns about Smith’s appointment. This dismissal further complicated efforts to hold Trump accountable for alleged interference in the 2020 election results.
