BREAKING: Stunning Reason Why Court Sacked Mutfwang As Plateau Governor

The Abuja Appeal Court has ousted the Plateau State Governor, Caleb Mutfwang.

In a verdict delivered on Sunday, the presiding Justice, Elfrieda Williams-Dawodu, directed the Independent National Electoral Commission (INEC) to grant a Certificate of Return to the All Progressive Congress candidate, Nentawe Goshwe.

Justice Williams-Dawodu nullified the Tribunal’s decision upholding Governor Mutfwang’s election, branding it as highly incompetent.

The court criticized the tribunal’s dismissal of the APC’s petition, contending that the party had no right to interfere in the affairs of the Peoples Democratic Party (PDP), the platform on which Mutfwang was elected. This, the court argued, violated Section 177 of the 1999 Constitution as amended and Section 134 (C) of the Electoral Act.

Contrary to the tribunal’s classification of the issues raised in the petition as pre-election matters, the court maintained that they were both pre-election and post-election matters and should not have been deemed statutorily barred.

Citing Section 177 of the Constitution, the panel noted that Mutfwang was not validly sponsored by the PDP during the election. It held that the PDP violated a court order mandating a valid congress in all 17 local government areas of the state by only conducting a congress in five local government areas, rendering it null and void.

Dismissing the decision of the Plateau State Election Petitions Tribunal, the court emphasized that the issue of qualification is both a pre-election and a post-election matter, contrary to the tribunal’s findings that the appellant lacked the standing to contest the respondent’s validity.

The court also pointed out that, according to Section 134 of the Electoral Act, it is the exclusive right of a political party to sponsor its candidate after meeting the necessary requirements.

Invoking Section 136 of the Electoral Act, the court directed INEC to revoke the certificate of return issued to Governor Mutfwang and issue a new certificate to Goshwe.

In concurrence with the judgment, Justice Okon Abang remarked that unless the PDP resolves its issues in Plateau State, it will continue to face self-inflicted misfortune.
