BREAKING: Supreme Court Reconvene, Dismisses Another Appeal (DETAILS)
The Supreme Court has rejected the appeal lodged by former Senator Smart Adeyemi, who represented Kogi West Senatorial District, contesting the outcome of the All Progressives Congress (APC) primary in the state.
Delivering a unanimous judgment on Monday, Justice Emmanuel Agim, speaking on behalf of a three-member panel of justices, stated that the appeal lacked merit.
“On the whole, this whole appeal fails for lack of merit,” he said.
Adeyemi contested the primary that resulted in the emergence of Ahmed Usman Ododo as the APC’s gubernatorial candidate for the November 11 election.

Nonetheless, the panel determined that Adeyemi did not demonstrate that the court’s judgment, which was based on concurrent findings of fact by both the high court and the Court of Appeal, was erroneous.
Furthermore, the panel ordered Adeyemi to pay the sum of N1 million each to the APC and Ododo.
Adeyemi’s case, filed with reference numbers FHC/ABJ/CS/556/2023, sought to have the Federal High Court declare the APC’s primary, which produced Usman Ododo as the candidate, as illegal, unlawful, and void for the November gubernatorial election.
He argued that the primary did not adhere to legal provisions.
This suit was dismissed by Justice James Omotosho on July 12. Justice Omotosho emphasized that the suit alleged forgery of primary results, a criminal offense that must be proven beyond reasonable doubt.
He added that failing to provide the forged results or the original documents was detrimental to the applicant’s case.
The Court of Appeal concurred with this decision and dismissed the appeal.
