Court Halts NERC’s Implementation Of Tariff Hike For Band A Customers
A Federal High Court in Kano has issued a restraining order against the National Electricity Regulatory Commission (NERC) and the Kano Electricity Distribution Company (KEDCO) from enforcing the new electricity tariff for Band A consumers. The presiding judge, Abdullahi Liman, granted an interim order on an ex parte motion, restraining NERC and KEDCO from proceeding with the tariff hike pending the hearing and determination of the motion on notice……READ ALSO Okuama Community Drag Nigerian Army To Court, Demands ₦100 Billion In Compensation
The court order also prohibits the defendants from intimidating or threatening to disconnect electricity supply to the applicants for their refusal to accept the increased tariff. The case, filed by Super Sack Company Limited and BBY Sacks Limited, alongside other plaintiffs including Mama Sannu Industries Limited, Dala Foods Nigeria Limited, Tofa Textile Limited, and Manufacturers Association Of Nigeria Limited (MAN), is marked FHC/KN/CS/144/2024.
The motion ex-parte was presented by Abubakar Mahmoud, counsel to the plaintiffs. NERC’s approval of the tariff increase on April 3 for Band A customers, who receive 20 hours of electricity supply daily, raised the tariff to N225 per kilowatt (kW), up from N66. However, the abrupt hike has faced criticism from the House of Representatives and other stakeholders, prompting calls for NERC to suspend its implementation.
