Okuama Community Drag Nigerian Army To Court, Demands ₦100 Billion In Compensation

This lawsuit, filed under reference number FHC/WR/CS/41/2024, stems from allegations of military invasion and destruction following an incident on March 14, 2024. During this event, 17 military personnel were reportedly killed amidst communal clashes during a peace mission.

Represented by 17 plaintiffs, including Victor Akemor and Madam Omotiwori Olarehor, the Okuama community accuses the military of violating their fundamental rights. Their legal counsel, Akpokona Omafuaire, emphasized the court’s jurisdiction over the matter, citing relevant sections of the 1999 Constitution.

Interestingly, the absence of the Nigerian Army during the initial hearing, with no legal representation present, raised eyebrows. Justice I. M. Sani, presiding over the case, has scheduled the next hearing for June 4 to delve into substantive issues.

The plaintiffs are demanding compensation for various alleged violations, including the dignity of human persons, fair hearing, private and family life, freedom of movement, choice of residence, and property ownership.

According to the lawsuit, the military operation resulted in extensive destruction within the Okuama community, sparing only a few structures like the Anglican Church, Okuama Secondary School, and the Aderha Primary School.

Furthermore, the plaintiffs accuse the military personnel of looting properties and imposing collective punishment without proper investigation or evidence linking the residents to the soldiers’ deaths.

The aftermath of the invasion, as described by community members, has been catastrophic, forcing them into destitute conditions in forests, bushes, and creeks, devoid of basic necessities and exposed to various risks.
