Defection: Wike’s Camp Receives Heat As PDP Takes Action On 27 Rivers Lawmakers
The Peoples Democratic Party (PDP) has urged the Independent National Electoral Commission (INEC) to organize fresh elections in the 27 state constituencies of Rivers State.
In a statement released on Monday, the party responded to the defection of 27 members of the Rivers State Assembly from the PDP to the All Progressives Congress (APC). The PDP called on INEC to declare the seats of the defected lawmakers vacant.

Citing Section 109 (1)(g) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), the PDP argued that the departure of the legislators from the PDP, the political party under whose platform they were elected into the Rivers State House of Assembly, automatically renders their seats vacant.

Citing Section 109(1) of the Constitution, the PDP national spokesman, Debo Ologunagba, who endorsed the statement, affirmed that “a member shall vacate their seat if they become a member of another political party before the expiration of the period for which the House was elected.” The PDP underscored that the Supreme Court’s unambiguous interpretation supports the assertion that the defected members have relinquished their seats, rights, privileges, recognition, and obligations.
In light of these constitutional provisions, the PDP called on the Speaker of the Rivers State House Assembly to promptly comply with the Constitution by declaring the seats of the 27 former lawmakers as vacant.
Acknowledging the now-existing vacancies in the 27 State Constituencies of Rivers State, the PDP urged INEC, within the stipulated period outlined in the Constitution of the Federal Republic of Nigeria, 1999 (as amended), to conduct new elections to fill the voids.
The PDP issued a warning to the lawmakers, cautioning them against presenting themselves as members of the Rivers State House of Assembly and emphasizing that such actions could result in charges of impersonation with serious legal consequences.
