The resolution was passed during Tuesday’s plenary, following a motion by Hon. Mansur Soro, who condemned the violation of Badejo’s fundamental human rights.

The military officials summoned include the Chief of Defence Staff, Gen. Christopher Musa; the Chief of Army Staff, Lt-Gen. Olufemi Oloyede; and the Commanding Officer of the 177 Battalion. They have been ordered to appear before the House Committees on Army, Human Rights, and Justice on Thursday, December 20, 2024, at 3:00 p.m.

Soro emphasized that the continued detention of Bello Badejo without formal charges contravenes the provisions of the Nigerian Constitution, specifically Sections 34, 35, and 36.

On December 9, 2024, Badejo was reportedly arrested in Maliya town, Nasarawa State, in a commando-style operation by 177 Battalion soldiers, allegedly linked to a dispute between the military and Maliya community members.

However, Soro expressed concern that even after a week, Badejo had not been arraigned before a competent court, as stipulated by law. He labeled the actions of the military as an egregious disregard for citizens’ constitutional rights.

The House of Representatives voiced its strong disapproval of the military’s actions and demanded accountability for the unlawful detention. Lawmakers unanimously supported the motion, stressing that no institution, including the military, is above the law.

The House resolved:

• To condemn the military’s attempt to bypass the police and judicial system in resolving civilian disputes.
• To demand the immediate release of Bello Badejo and a formal apology from the military for violating his constitutional rights.
• To summon top military officials to explain why officers under their command violated the law.

If the resolution is followed, the military will be forced to account for the detention, and the rights of Nigerian citizens will be upheld in accordance with the Constitution.
