SEC Paves The Way For Clearer Digital Asset Oversight In Nigeria

is playing a more significant role in regulating digital assets.
In August 2024, Busha Digital and Quidax Technologies became the first digital asset companies approved to operate in Nigeria. Emotimi Agama, the Director-General of the SEC, emphasized that some Virtual Asset Service Providers (VASPs) have not met the regulator’s standards and their applications will be rejected.
During a recent meeting with applicants, Agama stressed that the SEC is dedicated to clarifying complex issues to streamline the registration process. These remarks come after the SEC granted its first licenses under the Accelerated Regulatory Incubation Program (ARIP), with Busha Digital and Quidax Technologies being the inaugural firms to receive approval.
Comprehensive Registration for VASPs
Agama highlighted that the registration process for Virtual Asset Service Providers extends beyond simple onboarding. It encompasses monitoring, education, and surveillance, ensuring a robust regulatory environment. He assured stakeholders that the SEC is open to feedback and willing to revise regulations when justified.
“In the upcoming year, we aim to accelerate our progress, learning from the lessons gained throughout this process. A new law is already passed and awaits Presidential assent,” Agama stated.
Crypto Market Without a Legal Framework
Although Nigeria boasts one of the largest cryptocurrency markets globally, a dedicated legal framework has been absent until recently. Previously, the Central Bank of Nigeria (CBN), under Godwin Emefiele, primarily influenced the country’s crypto policies.
However, with recent leadership changes, the SEC has taken a more active role in shaping the industry’s future. Agama reaffirmed that the SEC’s objective is to ensure Nigeria remains a major player in the global crypto space while establishing a benchmark for effective regulation.
Combatting Fraud
One of the primary concerns for the SEC is addressing fraudulent activities. Recently, Nigeria’s Economic and Financial Crimes Commission (EFCC) arrested 792 individuals during a raid on a suspected hub for fraudulent schemes. These individuals allegedly used romance scams to deceive victims into investing in fake cryptocurrency schemes.
The operation took place on December 10 at the seven-story Big Leaf Building in Lagos, Nigeria’s commercial hub. According to EFCC spokesperson Wilson Uwujaren, among those arrested were 148 Chinese nationals and 40 individuals from the Philippines. Uwujaren noted that the facility operated as a call center targeting victims primarily in the Americas and Europe.
