The Court of Appeal determined that Justice Liman’s order was made without jurisdiction, thereby invalidating the fundamental rights enforcement suit filed by Aminu Babba Dan Agundi on behalf of the deposed 15th Emir, Aminu Bayero. The court clarified that the Federal High Court lacked authority to hear such a case.

This decision effectively concluded the protracted legal battle that had been a source of tension within the Kano Emirate.

Key Points from the Ruling
The appellate court stated that the Federal High Court should not have intervened in matters pertaining to the Kano State Emirate Council law. Led by Justice Mohammed Mustapha, the three-judge panel indicated that Dan Agundi’s claims on behalf of Bayero fell outside the realm of fundamental rights and were instead related to chieftaincy issues.

Referencing Section 251 of the Nigerian Constitution, the court pointed out that the Federal High Court is not equipped to address matters of chieftaincy.
