BREAKING: Tension In APC As Supreme Court Fixes Key Date For Judgment (DETAILS)

The Supreme Court has scheduled October 3rd for the verdict in the case filed by Senator Smart Adeyemi contesting the conduct of the All Progressives Congress (APC) primary election for the Kogi State governorship race.

Senator Adeyemi disputes the validity of the election that resulted in Usman Ododo becoming APC’s candidate for the November 11 governorship election in Kogi State. He asserts that the Electoral Act and APC guidelines were not properly followed during the primary election.

Specifically, Adeyemi, who recently represented Kogi West Senatorial District, argues that the results presented by APC in support of Ododo were fraudulent and invalid, pointing out that the primary was held in only 11 out of 239 wards in the state.

During the appeal hearing, Adeyemi’s counsel, Musibau Adetumbi, presented his arguments and requested the court to grant the reliefs sought by Adeyemi. Adetumbi argued that the primary election on April 14 was conducted in clear violation of section 84 of the Electoral Act, 2022, contending that the election did not take place in 228 wards, a claim substantiated by INEC’s field officers’ report on the primary.

Counsel for the APC, AbdulWahab Mohammed, urged the Court to dismiss Adeyemi’s appeal, citing that it contradicts the concurrent findings of fact by the Court of Appeal and the Supreme Court.

The counsel for the Independent National Electoral Commission (INEC) argued that the appeal was incompetent, affirming that the decisions of the two lower courts should stand.

Usman Ododo’s counsel also called for the dismissal of the appeal on the grounds that it has become irrelevant. He added that the 180-day period in which APC can hold another primary election for candidate nomination has expired.

Justice Inyang Okoro announced that the final verdict will be delivered on October 3, 2023, after hearing arguments from all parties involved.
