In a significant move to combat price gouging, the Federal Competition and Consumer Protection Commission (FCCPC) has announced new enforcement measures aimed at curbing the arbitrary pricing of goods and services across Nigeria. Tunji Bello, the Executive Vice Chairman and Chief Executive Officer of FCCPC, revealed these plans during a stakeholders’ meeting in Abuja, emphasizing the urgency of addressing this growing issue.

Uncovering the Truth Behind Price Inflation

Bello disclosed disturbing findings from recent market surveys conducted by the FCCPC. These investigations uncovered shocking discrepancies in pricing practices. For example, a fruit blender model known as Ninja was priced at $89 (about N140,000) in a supermarket in Texas, USA. In contrast, the same blender was listed at a staggering N944,999 in a Lagos supermarket, reflecting an inflation rate of over 500 percent. Just two weeks prior, the same item was priced at N750,000.

Bello questioned the rationale behind such drastic price increases, pointing out that there was no justifiable reason for such disparity.

Price Fixing and Market Manipulation

The FCCPC also investigated price fixing among market associations. Findings showed that some supermarkets in Abuja, Kano, Port Harcourt, and Lagos were involved in arbitrarily hiking prices without valid reasons. For instance, a toilet soap was sold for N2,600 in one Abuja supermarket, while it was priced at N1,950 in a Lagos store on the same day.

Bello highlighted the issue of inflated prices for food items and transportation, questioning the legitimacy of such practices and their impact on consumers.

The Role of Market Cartels and Price Manipulation

Bello explained how market cartels influence pricing in foodstuff markets. Cartels buy goods in bulk at low prices from producers and then sell them to retailers at significantly higher rates. This manipulation results in excessive prices for consumers. In the transport sector, the increased cost of petrol has led to higher fares, which subsequently impacts the prices of other goods and services.

FCCPC’s Approach and Future Steps

The FCCPC’s approach aims to address these issues without immediate punitive measures. Bello indicated that while the names of offending businesses are currently withheld, the commission expects them to adjust their prices to more reasonable levels following this public disclosure.

The FCCPC is committed to using dialogue and collaboration to foster fair market practices. This initiative aligns with President Bola Tinubu’s renewed hope agenda, which focuses on enhancing the welfare of citizens amidst economic challenges. Tinubu’s administration has already taken steps to alleviate food insecurity, such as providing fertilizer to farmers and removing tariffs on certain staple foods.

Legal Framework and Enforcement

Bello emphasized that price gouging and price fixing are illegal under the FCCPA. The commission has the authority to impose substantial fines and pursue legal action against offenders. For individuals, the law stipulates imprisonment of up to three years or a fine of up to N10 million, or both. For corporate bodies, penalties include fines up to 10% of their turnover from the previous year.
