In a video posted on X (formerly Twitter) on Saturday, Agbaje referenced Sections 223 and 225A of the Criminal Code Act, which criminalize activities related to prostitution, including procurement, facilitation, and financial gain.

According to the law, anyone found guilty of recruiting a girl or woman under 18 for illicit sexual activities, persuading a woman to become a prostitute, arranging her relocation within or outside Nigeria for prostitution, or residing with a prostitute is liable to imprisonment for two years.

Agbaje explained, “Sections 223 and 225 of the Criminal Code clearly state that any man who procures a woman for prostitution, profits from prostitution, or habitually associates with prostitutes is committing an offense.

“If you invite a ‘hook-up’ girl to your estate or home, just as you grant her access to your house, we will grant you access to prison.”

Reacting to Agbaje’s statement, Delta State Police Public Relations Officer, SP Bright Edafe, affirmed the legal consequences, stating, “You see that last part? She is the victim; you are the criminal. It is unfortunately true.”

Legal Implications of Prostitution in Nigeria

Under Nigerian law, Section 223 of the Criminal Code Act stipulates that any individual who:

1. Procures a girl or woman under 18 for unlawful sexual relations, whether within Nigeria or abroad.
2. Induces a woman to become a common prostitute.
3. Arranges for a woman to leave Nigeria to work in a brothel elsewhere.
4. Relocates a woman within Nigeria with the intent of engaging her in prostitution.

Such offenses are classified as misdemeanors, with a maximum penalty of two years’ imprisonment.

Similarly, Section 225A states that:

1. Any man who knowingly depends on prostitution earnings or persistently solicits for immoral purposes in public faces up to two years in prison.
2. A repeat offender, in addition to imprisonment, may also face corporal punishment.
3. Authorities can obtain warrants to search suspected premises and arrest men suspected of living off prostitution earnings.
4. Any woman found to be controlling or directing a prostitute’s activities for financial gain is also subject to a two-year jail term.

The law underscores Nigeria’s strict stance against all forms of prostitution-related activities, warning those involved of serious legal consequences.
