Bail Dispute: Malami And EFCC Clash Over Court Directive

Former Attorney-General of the Federation, Abubakar Malami, has publicly accused the Economic and Financial Crimes Commission (EFCC) of disregarding the rule of law. Malami claims that the anti-corruption agency failed to comply with a court order granting him bail.

According to reports, a Federal High Court in Abuja had approved bail for Malami. However, the EFCC, through its legal representatives, insists that it was not properly served with the court order.

In a statement issued by his media office, Malami’s spokesperson, Mohammed Doka, affirmed that the EFCC and its lawyers received the court order shortly after it was issued. The statement added that a court bailiff attempted to serve the documents at the EFCC office, but officials allegedly refused to acknowledge or accept them. “The claim by the EFCC that it was not served with the court order is incorrect and misleading,” the statement read, noting that proof of service exists.

EFCC’s counsel, Barrister Okutepa, SAN, rejected Malami’s claims, asserting that the commission had not been formally served and therefore could not be accused of disobeying a court directive it had not officially received. The lawyer emphasized that “due process must be followed not only in granting orders but also in serving them.”
