Dr. Olaleye, who had been convicted of child defilement and sexual assault by penetration by the Lagos Special Offences and Domestic Violence Court in October 2023, had been sentenced to life imprisonment. However, in November 2024, the Court of Appeal reversed the decision, citing errors in the lower court’s judgment and describing the evidence as “tainted” and “unreliable,” leading to his acquittal.
In its appeal, filed on December 27, 2024, the Lagos State government asked the Supreme Court to annul the appellate court’s ruling and reinstate the original conviction and life sentence. The state government also criticized the Appeal Court judges for disregarding key sections of the Evidence Act, particularly Section 209 (2), which mandates the corroboration of evidence from a child witness over the age of 14.
The case now heads to the highest court in the country for a final ruling, as the legal battle over Dr. Olaleye’s conviction intensifies.
