In the lead judgment delivered by Justice Umaru Fadawu, the court sided with Magaji’s attorney, Mr. Adeola Adedipe (SAN), asserting that the suspension order from the tribunal was prejudicial and deprived Magaji of a fair hearing.

Justice Fadawu ordered that the case be reassigned to a new panel at the CCT for further proceedings.

This ruling comes after the CCT, presided over by Justice Danladi Umar, had ordered Magaji’s suspension on April 4, 2024, based on allegations of misconduct from the Code of Conduct Bureau (CCB).

Justice Umar had previously ruled that the CCT possessed the jurisdiction to hear the case, dismissing Magaji’s objections to the order. The tribunal also directed Kano State Governor Abba Yusuf and the State Secretary to appoint an acting chairman for the PCACC during the trial to prevent any interference.

In response, Magaji appealed the decision to the Court of Appeal on April 5, putting forth five grounds for reversing the tribunal’s ruling. He contended that the CCT infringed upon his right to a fair trial and had unjustly determined his guilt through the suspension order.

Moreover, Magaji argued that the tribunal overstepped its authority by instructing the Governor and Secretary to appoint an acting chairman, as they were not involved in the case. He claimed the tribunal had speculated about his potential to influence witnesses without any substantial evidence.

Additionally, Magaji’s legal team asserted that the tribunal had raised concerns regarding contradictions in his affidavit without allowing him a proper opportunity to respond, thereby violating his right to a fair hearing.

With the Court of Appeal’s ruling, the case will now be re-evaluated by a new panel at the CCT, allowing for a fresh examination of the allegations against Magaji.
