Kano Emirate Crises: Bayero’s Legal-Team Exits Court, Withdraws-Representation (Details)
In a dramatic turn of events at a Kano High Court presided over by Justice Amina Adamu Aliyu, the legal team representing the 15th Emir of Kano, Aminu Ado Bayero, walked out and withdrew their appearance on Thursday.
Their decision came after the court declined to adjourn the case to allow them time to respond to claims made by the applicant in their originating summons.
Barrister Abdullahi Mohammed, speaking on behalf of the team, stated that they had no choice but to withdraw their appearance following the events in court. They intend to inform their client so he can appoint another counsel.
Aminu Ado Bayero is the primary defendant in a case filed by the Attorney General of Kano State and the Kano State House of Assembly seeking to remove him from the state and cease the activities of the deposed Emirs of Kano, Bichi, Gaya, Rano, and Karaye.
Despite the walkout, the judge proceeded with the hearing, noting that Bayero’s team had only withdrawn appearance but not their earlier processes before the court.
Daily Sun observed that the legal counsel for the other Emirs (3rd, 4th, and 5th defendants) did not participate in the walkout and continued to present their case in court.
They opposed the claims in the originating summons, arguing that the deposition of the five monarchs did not follow due process and laid-down procedures by the Kano State House of Assembly.
They urged the judge to nullify the repelled Kano Emirate Council Law 3924 and order the applicant to pay punitive damages of one billion Naira to the defendants.
Justice Amina Adamu Aliyu subsequently adjourned the case to July 18th to rule on various applications, including an extension of time sought by the 3rd, 4th, and 5th defendants, a notice of preliminary objection, an application to set aside the ex-parte order, an application to cross-examine the deponent, and the originating summons.
Commenting after adjourning the case, Justice Amina Adamu Aliyu expressed disappointment at the behavior of lawyers who attempt to intimidate the court. She noted the growing trend of lawyers walking out on court proceedings and emphasized that such actions are unfair to their clients.
