Judicial Transparency: Balogun Advocates Publishing Judges’ Names Before Appointment

is key to maintaining public trust in the judiciary.
The SAN Conundrum
Balogun also weighed in on the recent controversy surrounding the conferment of senior advocate status on too many lawyers. While acknowledging that the legal industry is not as big as its international counterparts, he believes that the number of SANs is not a reflection of the quality of lawyers in Nigeria.
Judicial Accountability
On the issue of judges mingling with politicians and extravagant swearing-in ceremonies, Balogun agrees that moderation is key. He advocates for a more sober approach to judicial appointments and ceremonies.
Retirement Benefits for Judicial Officers
Balogun also supports the proposal to grant retired judicial officers a pension and salary equivalent to those still in service. He believes that this would guarantee them a comfortable life after retirement and reduce the temptation to engage in corrupt practices.
The Nigerian Legal System
In his assessment of Nigeria’s legal system, Balogun notes that it is based on precedents and adversarial system inherited from the British Empire. He emphasizes the importance of avoiding conflicting court judgments by relying on established precedents.
Forum Shopping
On the issue of conflicting court judgments, particularly in cases involving Emirate tussles and political disputes, Balogun cautions against forum shopping by lawyers. He advocates for professional guidance by lawyers and adherence to the highest ethical standards.
Overall, Balogun’s views provide valuable insights into the challenges facing the Nigerian legal system and offer practical solutions for improving transparency, accountability, and professionalism within the judiciary.
