Tribunal Rejects INEC’s Request To Vary Orders In Atiku, Obi’s Favour

The Presidential Election Petition Tribunal rejected the Independent National Electoral Commission’s application to vary the orders it previously granted to the Peoples Democratic Party and Labour Party presidential candidates, Atiku Abubakar and Peter Obi, respectively, to inspect election materials used during the presidential election on Wednesday.

The restraining order was issued by the court in its ruling on Friday, which granted Atiku and Obi permission to inspect the sensitive materials used in the conduct of the February 25 election.

Both Atiku and Obi obtained an order to contest the election results, which they claimed were tainted by fraud and other irregularities.

The All Progressives Congress candidate, Bola Tinubu, was declared the winner of the election by INEC on March 1, but the PDP and LP candidates are contesting the result.

They then filed separate ex parte applications, requesting access to inspect sensitive materials used by INEC to conduct the presidential election.

However, INEC, in a motion on the notice filed on March 4, asked the court to modify the order prohibiting it from tampering with election materials.

The commission stated that the BVAS would need to be reconfigured for the next round of elections, which would take place on Saturday.

However, the court ruled on Wednesday that the application was unnecessary because it never granted Atiku, Obi, and their parties scientific access to and inspection of INEC’s database, including the Bimodal Voter Accreditation System devices.

The tribunal ruled that INEC’s concerns about the possible disclosure of voters’ identities and voting preferences were unnecessary because no applicant was granted permission to access INEC’s database.
