BREAKING: List Of Powerful Lawmakers At National Assembly Sacked By Appeal Court (FULL LIST)

Recent decisions by the Court of Appeal to remove several lawmakers from their positions have generated significant public discussion.

Elisha Abbo (Adamawa North) was the initial legislator to be unseated, followed by Abubakar Sadiku-Ohere (Kogi Central). Additionally, the Court of Appeal, Lagos Division, also nullified Darlington Nwokocha’s election.

Simon Mwadkwon (Plateau North) was the third senator to be disqualified by the appeal court. However, the court directed the Independent National Electoral Commission (INEC) to organize a re-run election within a 90-day period.

It is worth noting that Abbo and Sadiku-Ohere belong to the All Progressives Congress (APC), while Mwadkwon is a member of the PDP and serves as the minority leader in the Senate.

1. Kwankwaso vs Datti

The Court of Appeal in Abuja has removed Musa Ilyasu Kwankwaso of the All Progressives Congress and reinstated Yusuf Umar Datti of the New Nigeria People’s Party in the Kura/Madobi/Garun Malam Federal Constituency Election.

The three-panel led by Justice Tunde Oyebamiji Awotoye granted an Appeal by Yusuf Datti and ruled that the tribunal erred in counting the date of the Appellant’s resignation from his party on the day of its primary election. They also stated that Section 77 of the Electoral Act was wrongly applied, emphasizing that no court has authority over party membership matters.

2. Nwokocha vs Akobundu

The Court of Appeal, Lagos Division, also removed Darlington Nwokocha, the Senate Minority Chief Whip, who represented Abia Central on the platform of the Labour Party (LP).

The court affirmed Augustine Akobundu of the Peoples Democratic Party (PDP) as the legitimate victor of the February 25th election in the senatorial district.

Akobundu, a retired colonel, has previously served as a minister of state for Defence and held the position of national organizing secretary for the PDP.

3. Suswam vs Udende

The Court of Appeal in Abuja has also removed the former Governor of Benue State, Gabriel Suswam, from the Senate.

The Independent National Electoral Commission had declared Udende as the winner of the February 25 election, securing 135,573 votes and defeating Senator Gabriel Suswam of the Peoples Democratic Party, who garnered 112,231 votes.

In a unanimous decision by a three-member panel of Justices, the appellate court determined that Suswam was not the rightful winner of the senatorial election in Benue North East on February 25.

The court criticized the judgement of the Benue State National Assembly Election Petitions Tribunal, which reinstated Suswam of the Peoples Democratic Party, PDP, in the Senate. The tribunal had nullified the election victory of Mr. Emmanuel Udende of the All Progressives Congress, APC.

The Court of Appeal concluded that the tribunal had improperly assessed the evidence presented by the parties involved, leading to an erroneous conclusion that upheld Suswam’s petition contesting Udende’s election victory.

As a result, the court overturned the tribunal’s decision, affirming the validity of the appeal submitted by the APC candidate.

4. Senator Abbo vs Amos Yohanna

The Court of Appeal, Abuja Division, has also unseated Senator Ishaku Abbo, the representative of Adamawa North Senatorial District in the National Assembly.

The court nullified Abbo’s election on the platform of the ruling All Progressives Congress (APC) in favor of the Peoples Democratic Party (PDP) candidate, Amos Yohanna.

After hearing arguments from both sides, the Court of Appeal concurred with Usman’s assertion that, according to Section 137 of the Electoral Act, 2022, the presented results clearly demonstrated non-compliance with the Electoral Act.

Consequently, the court subtracted the invalid votes from both parties and determined that Yohanna and the PDP secured victory in the election with a majority of valid votes.

5. Hon. Jingi Rufai vs Hon. Jaafar Magaji

In the Federal Capital Territory, Abuja, an Appeal Court also removed Hon. Jingi Rufai, the representative for Mubi North, Mubi South, and Maiha of Adamawa State in the House of Representatives.

The court invalidated the candidacy of the People Democratic Party (PDP) in the 2023 National Assembly election, instead declaring Hon. Jaafar Magaji of the All Progressive Congress (APC) as the victor for the constituency. The court further directed INEC to issue Magaji a certificate of return.

6. Ohere vs Natasha Akpoti

The Abuja Division of the Court of Appeal has confirmed Natasha Akpoti-Uduagan (PDP) as the victor of the Kogi Central Senatorial Election that took place in February.

The court dismissed the appeal filed by Senator Abubakar Sadiku Ohere (APC, Kogi Central) for lacking merit.

In September, the Kogi State Election Petition Tribunal in Lokoja had annulled the victory of Ohere, the Senate Chairman Committee on Local Content, from the All Progressives Congress.

Subsequently, Ohere pursued his case at the appellate court for redress, but the court rejected his appeal and affirmed Akpoti-Uduagan as the rightful winner of the election.

7. Mohammed Salihu vs Abubakar Baba Zango

The Court of Appeal in Abuja has also reversed the ruling of the National Assembly Election Petitions Tribunal in Yola, Adamawa State, which had affirmed Mohammed Salihu as the valid nominee of the People’s Democratic Party (PDP) for the last House of Representatives election.

Salihu had contested for the Girei/Yola South/Yola North federal constituency election and emerged as the winner.

The lower court had dismissed the petition filed by Abubakar Baba Zango and the All Progressives Congress (APC), who argued that the PDP candidate was not eligible to run in the National Assembly elections on February 25, as he allegedly submitted a forged primary school certificate and birth certificate to the Independent National Electoral Commission (INEC).

Abubakar’s legal team had requested the tribunal to invalidate the election of the PDP candidate on these grounds and to compel INEC to issue him a certificate of return, as he had come in second place in the said election.

However, during the initial judgment, the tribunal’s chairman, Justice Aloysius Okuma, rejected Abubakar’s petition, stating that he failed to provide substantial evidence to support his allegations of certificate forgery, particularly in regards to the discrepancy in names.

Unsatisfied with the ruling, Abubakar’s lawyer, F.K. Idepefo, approached the Court of Appeal to overturn the judgment and declare his client as the legitimate House of Representatives member for the disputed constituency.

In his submissions, Idepefo argued that “the justices of the election tribunal completely misconceived the case of the appellants in resolving that Salih, Salisu, or Salihu is a misnomer or a variant of the name Salihu, as that was not the case of the appellants. Instead, the case of the appellants is that the certificates presented to INEC were forged.”
