JUST IN: Nigerians In Diaspora Sue Buhari, INEC, Ask High Court To Stop 2023 Elections

Nigerians of voting age living in the United Kingdom and other parts of the world have taken President Muhammadu Buhari and the Independent National Electoral Commission (INEC) to a Federal High Court in Abuja, seeking to have their fundamental right to vote in the 2023 general elections enforced.

They are requesting that the court stop Buhari and INEC from proceeding with the 2023 electioneering process until INEC’s voter register and bio-data base are updated to include them as registered voters.

Barrister Chikwe Nkemnacho and Kenneth Azubuike Nkemnacho, both of whom live in the United Kingdom, filed the suit on behalf of other Nigerians in the diaspora worldwide.

In the suit filed on their behalf by Augustine Temfeh-Nkemnacho, they ask the court to declare that they have the right to participate in the electoral process by registering to vote in 2023 and in all elections worldwide, in accordance with sections 13, 14, 42, and 17 of the 1999 Constitution.

The plaintiffs also requested that the court issue another declaration stating that INEC still has enough time to comply with sections 13, 14, and 15 of the 1999 Constitution.

They argued that if they are not allowed to vote in the 2023 elections and subsequent ones, their fundamental rights under the 1999 Constitution will be violated.

The defendants’ responses will be due on January 19, 2023, according to Justice Inyang Edem Ekwo, who is assigned to hear the case.

The four defendants in the suit are INEC, the Chairman of INEC, the President of the Federal Republic of Nigeria, and the Federal Republic of Nigeria, in that order.
