[BREAKING] Lawan Vs Machina: Supreme Court Delivers Verdict

On Monday, the Supreme Court of Nigeria overturned the decision of the Court of Appeal Abuja Division, which had affirmed Bashir Sherrif Machina as the authentic APC senatorial candidate for Yobe North in the upcoming general elections on November 28, 2022.

Justice Centus Nweze delivered the majority decision.

However, Justices Adamu Jauro and Emma Agim disagreed with the lead decision and issued a dissenting judgment, dismissing APC’s appeal and affirming the trial and appellate courts’ concurrent findings of fact.

Recall that Justice Monica Dongban-Mensen, who presided over a three-member appellate court panel, gave the affirmation in an appeal by the APC (appellant) challenging the decision of Justice Fadimatu Aminu of the Federal High Court Damaturu, which declared Bashir Sherriff Machina the winner of the party’s primary election on May 28, 2022.

However, after Machina was defeated in the APC presidential primary by Bola Tinubu, the party chose Senate President Ahmed Lawan to replace him. However, Machina insisted that he would not resign for the Senate President.

In the face of the controversy, the APC nominated the Senate President as its senatorial candidate for Yobe North to the Independent National Electoral Commission.

Machina went to court to seek redress after being dissatisfied with his party’s decision.

Machina specifically asked the court in his suit to declare him as the APC’s validly elected senatorial candidate for Yobe North Senatorial District.

Justice Aminu declared the parallel primary election that produced Lawan on June 9, 2022 invalid, claiming that the APC’s National Working Committee held a valid primary election on May 28 that was won by Bashir Sheriff Machina.

As a result, the trial judge ordered the APC to forward Machina’s name to INEC as the legitimate winner of the Yobe North primary election.
