Mohammed Mustapha, delivering the judgment on January 10, described the proceedings as “shoddy” due to the High Court’s failure to notify Muhammadu Sanusi about the hearing, effectively denying him the opportunity to defend his case.

Justice Mustapha emphasized that the court’s primary responsibility is to ensure fairness and allow all parties involved in the dispute to present their grievances. He stated, “The conduct of the proceedings without notifying Sanusi amounted to a travesty of justice.”

Consequently, the Appeal Court has ordered a fresh hearing of the case, which will be reassigned to a different judge by the Chief Judge of the Kano State High Court for a fair and expedited trial.

The legal dispute between Bayero and Sanusi revolves around leadership and governance within the Kano Emirate. The court criticized the lack of adherence to natural justice principles, asserting that no individual should be condemned without being heard.
