BREAKING: More Losses For Atiku As Appeal Court Sacks 3 PDP Reps Members (DETAILS)

In separate judgments on Tuesday, the Court of Appeal in Abuja upheld the nullification of the election of three members of the House of Representatives who were elected under the banner of the Peoples Democratic Party (PDP) in Plateau State.

The affected members of the House of Representatives are Peter Gyendeng representing Barkin-Ladi/Riyom Federal Constituency; Musa Bagos representing Jos South/Jos East Federal Constituency; and Beni Lar, a fifth-term lawmaker who represented Langtang North/Langtang South Federal Constituency.

The court determined that their nominations by the PDP were invalid and that the party violated an existing court order when it put them forward as its candidates for the National Assembly election held in the state on February 25.

The appellate court emphasized that the PDP failed to comply with an order, issued in a suit numbered PLD/J/304/2021, which directed the party to conduct a fresh Congress involving all 17 Local Government Areas in Plateau State.

Instead of adhering to this directive, the PDP proceeded to nominate candidates who ultimately won elections in their respective constituencies.

The court ruled that the order issued by a High Court in Plateau State, as a judgment in Rem, was not only binding but also sacred, and should have been fully followed.

The Justice Elfrieda Williams-Dawodu led three-member panel of the appellate court noted that evidence provided by the PDP to demonstrate compliance with the court judgment revealed that 12 LGAs were excluded from the purported fresh congress due to legal issues.

This failure to comply with the court order was deemed fatal to the party’s case.

As a result, the appellate court affirmed the decision of the Justice Mohammed Tukur-led Plateau State National Assembly Elections Petition Tribunal, which had previously determined that since all the votes garnered by the PDP candidates in the poll were invalidated, candidates from other political parties with the second highest vote counts should assume their positions.

The individuals identified by the appellate court to take over the legislative seats were Dalyop Chollom and Ajang Alfred Iliya of the Labour Party for Barkin-Ladi/Riyom Federal Constituency and Jos South/Jos East Federal Constituency, respectively. Vincent Bulus Venman of the APC was identified for Langtang North/Langtang South Federal Constituency.

Furthermore, the court imposed a cost of N2 million against the Independent National Electoral Commission (INEC) for filing appeals to challenge the tribunal’s judgment. The court held that INEC, as an independent arbiter, should not have filed an appeal in support of any candidate. The appellate court panel also included Justices Muhammed Mustapha and Okon Abang.
