BREAKING: What Court Of Appeal Just Did To Uba Sani As Kaduna Governor

The Court of Appeal in Abuja has upheld the election victory of Uba Sani from the All Progressives Congress (APC) as the governor of Kaduna State.

In its judgment delivered on Friday, a three-member panel of the appellate court ruled that the tribunal made an error by relying on inadmissible evidence to order supplementary polls in 22 polling units across four local government areas (LGAs) where the exercise was considered inconclusive.

The court determined that a crucial witness presented by the Peoples Democratic Party (PDP) during the tribunal hearing provided hearsay evidence, as he was not present when the alleged malpractices occurred.

Regarding allegations of vote deduction, ballot box stuffing, and mutilation of sensitive electoral materials, the court found that these were based on hearsay.

Furthermore, the court upheld the tribunal’s dismissal of the PDP and Isa Ashiru’s petition, asserting that the petitioners had abandoned their case by failing to apply for the issuance of a pre-hearing information sheet after the close of pleadings, as mandated by paragraph 18(1) of the first schedule to the Electoral Act 2022.
