BREAKING: What Tribunal Has Ordered INEC To Produce Today In Court As Judgement Draws Close

The governorship election tribunal in Kaduna State has ordered the Independent National Electoral Commission (INEC) to ensure that its subpoenaed witness appears on Thursday, as per the tribunal’s previous order.

This decision came after the 1st and 2nd petitioners, Isa Ashiru and his party, Peoples Democratic Party (PDP), requested that an arrest warrant be issued on INEC for failing to present a witness before the tribunal on Wednesday.

The counsels representing the 1st respondent (INEC), 2nd respondent (Uba Sani), and 3rd respondent (APC) argued against the application made by Oluwole Iyamu (SAN), who is the counsel for the 1st and 2nd petitioners, Ashiru and PDP. They argued that the court should decline the request for the arrest of the Resident Electoral Commissioner (REC) as the petitioners did not follow the proper process.

According to the counsels, before any party can talk about compliance with a court order, there must be clear evidence that the subpoenaed person has been duly served.

Ashiru’s counsel countered that INEC deliberately attempted to frustrate the court’s order, despite having followed the correct procedure.

He stated, “We are urging the tribunal to assert the authority of the court and ensure that no public servant undermines the court’s order.”

After hearing the arguments from all the counsels, the three-man panel of the tribunal directed that the INEC’s subpoenaed witness be present on Thursday.
