BREAKING: 7 Days To Presidential Election, Court Delivers Strong Ruling In Ex-Minister’s Suit Against Tinubu’s Candidacy

The Court of Appeal in Abuja has dismissed a suit filed by a group loyal to a former Minister of State for Education, Chukwuemeka Nwajiuba, seeking the annulment of Asiwaju Bola Tinubu’s nomination as the All Progressives Congress presidential candidate (APC).

In a decision issued on February 17, a three-judge panel of the court ruled that the appeal by the Incorporated Trustees of Rights for All International (ITRAI) was incompetent.

It upheld the APC’s objection that the appellant’s suit filed at the trial court, the Federal High Court in Abuja, was not a pre-election matter because the appellant was not a person covered by Section 285(14) a, b, c of the 1999 Constitution because it was an NGO.

The appellate court ruled that the removal of Nwajiuba, who was a party in the lower court case, meant that the lower court’s decision was not appealed.

The appellant’s price of appeal was then dismissed by the court. On the merits, the court dismissed the entire appeal because it lacked merit.

The court noted that the appeal was an attempt by the appellant – the Incorporated Trustees of Rights for All International – to resurrect itself after being dissolved by the trial court’s decision.
