BREAKING: 43 Days To Election, Court Nullifies PDP Primary Election Winner Candidacy, Tells INEC What To Do

Mister Francis Agbo has been declared the validly nominated candidate of the Peoples Democratic Party (PDP) for the Ado/Okpokwu/Ogbadibo Federal Constituency of Benue State by the Court of Appeal in Abuja.

The appellate court’s three-member panel unanimously decided that Ms Aida Ogwuche, who was declared the winner of the PDP primaries by the Independent National Electoral Commission (INEC), was still employed by the Federal Inland Revenue Service at the time of the election.

Agbo, who also serves as Chairman of the House Committee on Narcotics and Drugs, finished second in the contentious primary election.

As a result, the court ordered INEC to immediately withdraw the certificate of return issued to her and issue it to Agbo as the party’s validly nominated candidate for the federal seat.

Justice B. I Gafai, who presided over the panel of justices, stated that Ogwuche should have resigned from the service before running in the PDP primary election.

The judge declared Ogwuche’s election illegal and invalid under Section 66 (I) (f) of the 1999 Constitution.

On November 11, 2022, the Federal High Court in Makurdi declared Ogwuche to be the duly elected candidate of the PDP for the Ado/Okpokwu/Ogbadibo Federal Constituency.

Agbo had petitioned the trial court for an order disqualifying Ogwuche’s candidacy on the grounds that she had not resigned her appointment 30 days before running for office.
