During the recent proceedings, Adeola Adedipe, the former minister’s counsel, urged the court to grant bail to his client under self-recognizance or lenient conditions, asserting that Agunloye poses no flight risk.

Adedipe contested the prosecution’s concerns, attributing them to misunderstandings and communication issues.

He also sought the court’s discretion to refrain from requiring a public servant as surety for Agunloye.

Adedipe emphasized the applicability of Section 352(4) of the Administration of Criminal Justice Act (ACJA), stating that even if a defendant granted bail flees, the trial can proceed, and a conviction can be secured.

However, the prosecution opposed the bail application. Justice Onwuegbuzie, in delivering the ruling, leaned towards granting bail to the defendant.

Agunloye was subsequently granted bail at N50 million, requiring two sureties of similar financial standing and good reputation within the FCT.

These sureties must possess properties valued at N300 million with verifiable Certificates of Occupancy, and they need to submit identification documents and passport copies to the court.

The defendant must surrender his passport and attend all hearings. The case is adjourned until February 12.

The Economic and Financial Crimes Commission (EFCC) is investigating Agunloye in connection with the $6 billion Mambilla Hydropower Contract.
