President Bola Tinubu has taken legal action to dismiss a subpoena filed against him by the presidential candidate of the Peoples Democratic Party (PDP), Atiku Abubakar, in the Circuit Court of Cook County, Illinois, Chicago, USA.

On July 11, Atiku filed a petition seeking additional information about Tinubu’s academic records at Chicago State University.

The documents requested include Tinubu’s admission and acceptance records, dates of attendance, degrees, awards, and honors obtained during his time at the university, among other details.

Atiku stated that the subpoena was necessary to verify the truth and accuracy of Tinubu’s claims, considering Tinubu’s current position as the President of Nigeria and ongoing court proceedings concerning his election and the authenticity of documents related to his education at Chicago State University.

However, in response to the petition, Tinubu’s counsel, Victor P. Henderson, filed a reply on July 19, requesting the court to dismiss the subpoena.

Henderson argued that no judge of the court had heard and approved Atiku’s request for the subpoena. He further contended that the petition was invalid as it only allowed six days for compliance, which is less than the 14 days required under Rules 219 and 137 of the Illinois Supreme Court Rules.

Additionally, Henderson accused Atiku of engaging in an improper attempt to seek information about a foreign public official using the court’s subpoena power.
