Defection Drama: PDP Moves To Strip Ibori’s Daughter Of Her Parliamentary Seat

All Progressives Congress (APC). The lawsuit, filed at the Federal High Court in Warri, challenges the validity of Ibori-Suenu’s continued representation in the House of Representatives after switching allegiance to the APC.
The legal suit, registered under case No: FHC/WR/CS/126, was filed by PDP’s legal team, headed by Dr. Ayo Asala SAN. In the lawsuit, the party is requesting the court’s interpretation of Section 68(1)(g) of the 1999 Constitution, which addresses the issue of defections by elected officials.
The PDP’s petition aims to achieve the following:
- Declare Ibori-Suenu’s Seat Vacant: The PDP argues that, under the Constitution, Ibori-Suenu must vacate her seat in the House of Representatives because she defected from the party that sponsored her election (PDP) to the APC.
- Constitutional Responsibility of Key Institutions: The PDP seeks a declaration that the Speaker of the House of Representatives, the House itself, and the Independent National Electoral Commission (INEC) are constitutionally obligated to declare Ibori-Suenu’s seat vacant due to her defection.
- Vacancy Declaration for Ethiope East/West Federal Constituency: The party wants the court to declare the seat for the Ethiope East/West Federal Constituency vacant and instruct Ibori-Suenu to immediately vacate her position.
- Permanent Injunction: The PDP is seeking a permanent injunction barring Ibori-Suenu from carrying out any legislative duties as a member of the House of Representatives, due to the defection.
- By-election Order: The PDP also requests that INEC be directed to conduct a by-election to fill the vacancy created by Ibori-Suenu’s defection.
- Refund of Salaries and Allowances: The PDP seeks an order for Ibori-Suenu to refund all salaries, allowances, and benefits she received as a member of the House of Representatives since her defection to the APC.
This legal action aims to reinforce the constitutional provisions surrounding defections, ensuring the legitimacy of legislative representation and adherence to the principles of democracy.
