BREAKING: LP’s Claim Tinubu Not Duly Elected President Unmeritorious – Tribunal
The Presidential Election Petitions Court delivered a verdict on Wednesday, dismissing the petitions filed by the Labour Party (LP) and its presidential candidate, Peter Obi. These petitions had claimed that President Bola Tinubu of the All Progressives Congress (APC) was not legitimately elected in the February 25, 2023 election.
Regarding LP’s argument that Tinubu should not be declared the winner because he did not secure more than 25 percent of the votes in the Federal Capital Territory (FCT) and was not duly elected by the majority of lawful votes cast, the Tribunal characterized this argument as “ridiculous.”
The five-member panel, led by Justice Haruna Tsammani, considered the principles of state policy and the constitution’s preamble, which advocate for the equality of citizens. They concluded that, according to the provisions of Section 134(2a) of the constitution, it is not mandatory to score 25 percent in the FCT in a presidential election. The court, without any ambiguity, resolved this issue against the petitioner and in favor of the respondent.
Consequently, the court declared the LP’s petition to be devoid of merit.
