Fagbemi made the assertion on Thursday during an event, clarifying that while the details of the political situation in Edo remain unclear, it is unlawful for the state House of Assembly to exercise such powers. He emphasized that the only body with the legal right to suspend local government leaders is the Legislature at the local government level.

This statement comes after the Edo House of Assembly passed a resolution on Tuesday to suspend the chairmen and vice chairmen of the state’s 18 Local Government Areas for two months. The Assembly further directed the leaders of the LGAs’ legislative arms to assume control of their councils during the suspension period.

In response to the controversy, the Special Adviser to Governor Monday Okpebholo on Legal Matters, Andrew Emwanta, defended the suspension, claiming it was in line with the Constitution. Emwanta also pointed out that previous governors, including Adams Oshiomhole and Godwin Obaseki, had suspended local council chairmen during their terms in office.
