Upon the appeal filed by his lawyer, Ines Guardiola, and a hearing held on Tuesday, the 40-year-old has been released until a final resolution is reached on the appeal.

As part of the bail conditions, Alves must surrender his Spanish and Brazilian passports and remain within Spain, subject to weekly court check-ins. Additionally, he is obliged to adhere to a restraining order preventing him from approaching within 1,000 meters of his victim’s residence, workplace, or any other frequented location.

The court’s ruling issued on Wednesday allows a three-day appeal period for the defense, the victim’s legal representatives, and the prosecution.

Earlier reports indicated that Alves was convicted on February 22 for raping a young woman at a Barcelona nightclub in December 2022. The victim’s testimony, delivered anonymously behind a screen, provided a harrowing account of the violent encounter in the nightclub’s private bathroom, despite her pleas for Alves to stop.

The court’s decision, outlined in a 61-page document, dismissed the defence’s argument of mutual “sexual tension” and emphasized that such interpretation did not imply consent for subsequent actions.
