Disobey VIO? Arrest And Prosecution Await – Ministry Issues Strict Warning

The Lagos State Ministry of Justice has emphasized that motorists who fail to comply with Vehicle Inspection Service (VIS) officers on state roads risk arrest and prosecution. According to Ireporter Online, this clarification follows widespread misinterpretation of a recent court ruling in Abuja regarding the authority of Vehicle Inspection Officers (VIO).

The ministry noted that the Court of Appeal in Abuja upheld a Federal High Court decision, which determined that VIO officials in the Federal Capital Territory (FCT) lack the legal authority to stop, impound vehicles, or impose fines on drivers. However, the ministry clarified that this ruling applies exclusively to the FCT and other regions without a statutory framework for vehicle inspection.

Lagos State, unlike the FCT, has established laws creating the VIS and clearly defining the powers of its officers. Enforcement activities by VIS personnel on Lagos roads are therefore lawful and constitutional.

Motorists are expected to cooperate with VIS officers during traffic operations to avoid penalties. The Lagos State Government reassured the public that traffic enforcement will continue to be conducted in accordance with the law while ensuring motorists are treated with civility and respect. Any individual who disobeys or assaults a VIS officer performing official duties will face arrest and prosecution.
