Mastermind Of 9/11 Attacks Faces Delayed Justice Amid US Court Battle

The men had agreed last summer to plead guilty in exchange for avoiding the death penalty.
In a filing to a federal appeals court, the government argued that accepting the pleas would cause “irreparable harm” by denying the opportunity to pursue capital punishment for the accused. A three-judge panel placed the proceedings on hold, stating that the delay was not a judgment on the case’s merits but necessary for further review.
This decision follows previous rulings from a military judge and appeals panel rejecting efforts by Defense Secretary Lloyd Austin to void the plea deals, which had been approved by a senior official under his authority.
The case, which has spanned over two decades, is mired in legal complexities, including debates over the admissibility of evidence obtained under torture during the defendants’ detention in CIA facilities. Mohammed, arrested in 2003, was subjected to extensive waterboarding and other “enhanced interrogation techniques.”
Families of 9/11 victims remain divided. Some see the plea deals as a way to resolve the long-delayed case, while others criticize them as too lenient. “The U.S. government failed the 9/11 families again,” said Tom Resta, whose brother, sister-in-law, and their unborn child were killed in the attacks.
The plea agreements include provisions for a military jury to determine sentencing and allow victims’ families to question Mohammed, who would be required to respond truthfully. The delay shifts the decision on the plea deals to the incoming Trump administration.
The appeals court stated that the postponement was necessary to expedite a full review and that no significant harm would result from the brief delay.
