See What The Court Of Appeal Just Did To Judgement Against Rivers APC Governorship Candidate, Tonye Cole

The Court of Appeal in Port Harcourt on Friday overturned a Federal High Court decision that disqualified Tonye Cole, the All Progressives Congress governorship candidate in Rivers State, for alleged dual citizenship and non-compliance with the Electoral Act.

The APC and the Independent National Electoral Commission were also named as defendants in the Peoples Democratic Party’s High Court suit.

The PDP was described as a “messy interloper” by the Court of Appeal.

In a unanimous decision, the three-man appellate panel said the PDP lacked locus standi to challenge the APC, its Governorship Candidate, and INEC on the conduct of the congresses and primary elections that produced Cole as the candidate.

On the issue of dual citizenship, the Appeal Court ruled in a decision read by Justice Olabode Adegbehingbe on behalf of Justice Joseph Ikyegh that the PDP lacks the legal right to sue INEC in a pre-election matter.

According to the panel, the Supreme Court’s decision on the issue of citizenship in electoral matters is final.

Chimenem Jerome, counsel for the APC, described the decision as “a watershed in political jurisprudence” to journalists outside the court.
