Cybercrimes (Amendment) Act of 2024. The lawsuit argues that the law infringes on free speech, targeting activists, journalists, bloggers, and social media users.

The case, filed under suit number ECW/CCJ/APP/03/2025 at the ECOWAS Community Court of Justice in Abuja, highlights concerns over the law’s vague provisions, especially in relation to “cyberstalking” and actions causing a “breakdown of law and order.” SERAP claims the law is being misused to intimidate critics, with activists like Dele Farotimi and journalist Agba Jalingo already facing accusations of cyberstalking.

SERAP urges the court to declare the law unconstitutional, citing violations of Nigeria’s international human rights obligations. The organization is seeking the immediate repeal or amendment of the law to align with human rights standards.
