BREAKING: Court Delivers Ruling On Abba Kyari’s Application To Quash Charges

The Federal High Court in Abuja dismissed an application seeking to dismiss charges against a suspended Deputy Commissioner of Police, Abba Kyari, on Wednesday.

Justice Emeka Nwite Kyari dismissed the application, stating that the court has the exclusive right and jurisdiction to hear drug-related cases, as enshrined in the Federal Republic of Nigeria’s Constitution and the National Drug Law Enforcement Agency (NDLEA) Act.

According to Justice Nwite, section 251 of the constitution gives the court the authority to hear and decide the charge.

Kyari had told the court that the charges against him were premature, arguing that the NDLEA should have given police time to exhaust their internal resources before taking action.

He informed the court that the Police had already begun an investigation into the allegations leveled against him and had issued an interim report.

Kyari insisted that he could not be charged in court until the police conducted an internal investigation.

He contended that the PSC, like the National Judicial Council (NJC), has similar powers to investigate and discipline erring police officers in accordance with the Police Act and Regulations.

However, the judge stated that the Police Service Commission’s powers do not supersede those of the Federal High Court.
