The Benue State Governorship Election Petition Tribunal, seated in Makurdi, has affirmed the victory of Governor Hyacinth Alia from the All Progressives Congress (APC).

The tribunal rejected the petition from the Peoples Democratic Party and their governorship candidate, Titus Uba, contesting the election held on March 18. They cited lack of jurisdiction to hear the case.

Justice Ibrahim Karaye, the chairman of the three-member panel of justices, stated that the tribunal lacked jurisdiction to entertain the petition since the issues raised fell under pre-election matters as outlined in section 285 of the Electoral Act.

The tribunal based its decision on the premise that the petitioner should have pursued their case concerning Governor Alia’s qualification and nomination by the APC, as well as the allegations of a forged certificate and false information on form EC9 against his deputy, Sam Ode. These matters should have been taken up with the Independent National Electoral Commission (INEC), and not before the Federal High Court, which had previously dismissed the petitioner’s initial suit and referred it to the Court of Appeal, not the tribunal.

As per the results declared by INEC after the March election, Catholic priest Alia secured 473,933 votes, while his closest contender, Uba, garnered 223,913 votes.
