JUST IN: Appeal Court Upholds Nullification of PDP Guber Primary In North-West State

The Court of Appeal in Sokoto, presided over by Justice Muhammad Shuaibu, dismissed an appeal filed by Peoples Democratic Party (PDP) governorship candidate in Zamfara, Dr Dauda Lawal, challenging the nullification of his candidature.

In a unanimous decision, Justice Shuaibu stated that the appeal was an abuse of the judicial process and lacked merit.

Shuaibu went on to say that the apeallant had no right to appeal the judgment he had already obeyed.

He noted that the appeal was an academic exercise and thus awarded N100,000 to the respondents against the appellant.

Ibrahim Shehu, a PDP gubernatorial aspirant in Zamfara state, had challenged the election that returned Dr Dauda Lawal, a PDP candidate in the state, claiming that the election was marred by irregularities and noncompliance with the electoral act and PDP guidelines.

He had petitioned the Federal High Court in Gusau, which later declared the primary null and void and ordered the PDP to hold a rerun within 14 days.

The PDP obeyed the ruling, held the rerun, and Dauda Lawal was re-elected. Shehu went back to the same High Court, insisting that there was no election. The high court ruled in his favor, stating that the PDP does not have a governorship candidate for the 2023 election.

Aminu Aliyu, the appeallants’ lawyer, responded that his client had the option of appealing the decision to the Supreme Court.

Ndiana Anaka, a lawyer for the respondents, said the decision was a victory for democracy and the rule of law.

“What is right is right, and what is wrong is wrong,” he said.
