Sources within the commission revealed that the questioning followed the interception of the judge’s wife by EFCC operatives during a trip. The circumstances surrounding the funds and the purpose of the trip have not been officially clarified.

Justice Tsoho is expected to appear before the Code of Conduct Bureau (CCB) on March 16, 2026, over allegations relating to asset declaration. A petition accused him of failing to declare certain assets, including three accounts with United Bank for Africa and one with Access Bank. Under Nigerian law, public officials are required to declare all assets, liabilities, and bank accounts, including domiciliary accounts. If a prima facie case is established, charges could be initiated, with potential penalties including up to 10 years imprisonment and a 10-year ban from holding public office.

Agabi has indicated his willingness to accompany the Chief Judge to the bureau upon his return to Nigeria.
