Tension As Court Delivers Heavy Verdict In PDP’s Suit To Disqualify Omo-Agege From Delta Guber Election

A Federal High Court in Abuja has dismissed the Peoples Democratic Party’s (PDP) request to disqualify the incumbent Deputy Senate President, Augustine Ovie Omo-Agege, from running in Delta State’s governorship election on March 11, 2023.

The PDP’s suit for disqualification was dismissed by the court due to a lack of diligence in prosecuting the suit.

The PDP had taken the Independent National Electoral Commission, INEC, the All Progressives Congress, APC, and Omo-Agege to court, requesting that the Deputy Senate President and his party be barred from running in the election due to alleged violations of the Electoral Act 2022.

The main complaint of the PDP was that the APC and Omo-Agege violated sections 285 (14) of the 1999 Constitution and sections 30, 32, and 73 of the Electoral Act 2022 by submitting Omo-nomination Agege’s form manually rather than through INEC’s online Nomination Portal.

PDP claimed that because submitting nomination forms through the INEC Nomination Portal is required by law, INEC should not have published Omo-name Agege’s on October 4 last year.

The PDP sought a mandatory injunction directing INEC not to publish Omo-name Agege’s as an eligible candidate for the upcoming Delta State governorship election.

The party also requested another order prohibiting the APC and Omo-Agege from parading or further parading themselves as candidates in the election.

During the proceedings, however, Justice Inyang Edem Ekwo noted that the PDP, as the plaintiff in the suit, had failed to appear in court through legal representation three times in a row to present its case and had also failed to provide any information.

Justice Ekwo ruled that the plaintiff’s persistent non-appearance in court proves that the suit has been abandoned.

The judge dismissed the FHC/ABJ/CS/1907/2022 suit for failure to prosecute diligently.
