Human rights lawyer, Femi Falana, SAN, has urged the Department of State Services (DSS) to promptly release the suspended Chairman of the Economic and Financial Crimes Commission (EFCC), Mr. Abdulrasheed Bawa, from unlawful custody.

Falana emphasized that the remand order issued by a Magistrate Court in the Federal Capital Territory has lost its validity, making it illegal for a criminal suspect to be detained for 67 days without trial under the provisions of the Administration of Criminal Justice Act, 2015, or section 35 of the Nigerian Constitution.

In an official statement that was stamped and provided to the media on Sunday, Falana also called upon the Federal Government to ensure that the rights of the suspended Governor of the Central Bank of Nigeria, Godwin Emefiele, and Bawa are upheld by both the DSS and the Director of Public Prosecution’s office in the Federal Ministry of Justice.

He acknowledged that while both individuals previously demonstrated a tendency to defy court orders during their tenures, their current predicament should serve as a lesson for all public officers in the country.

Falana emphasized that the government must abide by the law and avoid infringing upon the fundamental rights of citizens except in accordance with the provisions laid out in the Nigerian Constitution.
