BREAKING: Court Takes Strong Action In Suit Challenging Tinubu’s Candidacy

The Federal High Court in Abuja has dismissed a case challenging the All Progressives Congress (APC) presidential candidate, Asiwaju Bola Ahmed Tinubu, ahead of the 2023 elections.

Bayo Onanuga, the APC Presidential Campaign Council’s Director of Media and Publicity, confirmed the dismissal in a statement.

It was noted that in recent weeks, the courts had dismissed several cases brought against Tinubu by opposition elements, including Action Alliance, as frivolous, without merit, and an abuse of court processes.

In the case with suit no FHC/ABJ/CS/854/2022, Justice Fadima Aminu Muritala referred to the plaintiff, Elder Ngozika Ihuoma, as a “meddling interloper with no locus standi to institute the suit.”

The most recent case is the fourth to be dismissed by the courts in recent weeks.

After APC’s counsel, Julius Ishola Esq from Babatunde Ogala & Co urged the Court to dismiss the case with heavy costs for wasting judicial time, Justice Muritala dismissed it as speculative.

Ihuoma filed a lawsuit against Tinubu and five others on June 9, 2022, after Tinubu won the APC presidential primary election.

He sought six reliefs, including an injunction barring Tinubu from running in the 2023 presidential election.

In response to the suit, the law firm of Babatunde Ogala (SAN) & Co filed a counter affidavit in opposition to the Originating Summons and a Notice of Preliminary Objection on behalf of the All Progressives Congress.

The counter-affidavit called Ihuoma’s locus standi and grounds for the action into question.

It asked the court to rule that the case was speculative, pre-emptive, and non-justiciable because it involved the internal affairs of a political party.

The counter-affidavit also criticized Ihuoma’s case as academic, theoretical, and an abuse of the legal system.

On Monday, the court upheld the defense counsel’s objections and dismissed the case.
